NOTICE TO DEFENDANTS
Notice to Defendants and Service of Summons, Complaint, Temporary Restraining Order, and Order to Show Cause
We are legal counsel to Airigan Solutions, LLC (“Plaintiff” or “Airigan”). This letter serves as notice that a lawsuit has been filed by Plaintiff against you (“Defendant”) in the United States District Court for the Western District of Pennsylvania, Case No 19-cv-1966, Airigan Solutions, LLC v. Babymove, et al. (“Lawsuit”). All relevant documents may be accessed and downloaded below.
On February 14, 2019, the Court entered an ex parte Temporary Restraining Order, Order Restraining Assets and Merchant Storefronts, Order to Show Cause Why a Preliminary Injunction Should Not Issue, Order Authorizing Service by Electronic Means and Order Authorizing Expedited Discovery against Defendants (“Order”).
Pursuant to the Order, on February 27, 2019, at 3:00 p.m. ET, United States District Judge Nora Barry Fischer will conduct a Show Cause Hearing in Courtroom No. 5B of the Pittsburgh Courthouse, United States District Court for the Western District of Pennsylvania, located at 700 Grant Street, Pittsburgh, Pennsylvania, 15219, after which time she may enter a preliminary injunction (“PI Order”) against each Defendant, which may extend through the length of the Lawsuit.
Please also be aware that if Defendant fails to respond to the Complaint within twenty-one (21) days from the date of this letter, it will be in default, and the Court can issue a default judgment against Defendant awarding financial damages and a permanent injunction.
Since we represent Airigan, we are unable to provide you with legal advice. Accordingly, we strongly advise that you retain an attorney to assist you in this Lawsuit.
